Terms and Conditions
1. General conditions
1.1. These General Terms and Conditions govern, without limitation, the sale of products between http://colton.eu/ shop (the Seller) and the Customers. Any order for a Product offered on the Website implies the Customer’s full acceptance of these terms and conditions. With the confirmation of the order, they constitute a contract between the Seller and the Customer.
1.2 The Seller reserves the right to change these Terms at any time by posting a new version on the Website. The General Terms and Conditions of Sale shall apply to those who have placed an order on the Website by adding the Goods to the Card, accepting the Terms and Conditions and clicking on “Order”.
2. Purpose
2.1. These General Terms and Conditions of Sale shall govern the rights and obligations of the Parties arising out of the sale of products offered on the Website.
2.2. Goods purchased on http://colton.eu/ are sold through a company called MB Colton gj, which offers them good quality products delivered with all the necessary accessories as specified in the shop.
2.3. Confirmation of these Terms and Conditions of Sale, the emailing of the Order Summary to the Customer and the Customer’s payment shall constitute evidence of the formation of a contract between the Seller and the Customer, to which these Terms and Conditions shall apply. Customers must be of legal age and have the capacity to enter into such a contract, otherwise it shall be void.
3. Processing of personal data
3.1 Registration
3.1.1 The accuracy of the personal data provided by the Customer is the sole responsibility of the Customer;
3.1.2. When creating his/her account, the Customer shall choose a login name and a password that will be specific to identify him/her on the Site. He is responsible for the confidentiality of these elements and shall not provide them to any unauthorised third party.
3.1.3. Using their identifiers, the Customer can log into their account at any time (outside of temporary maintenance periods of the Site) to place an Order, track their Orders or deliveries in progress or manage their personal information.
3.2 Placing an order
3.2.1. The customer can place orders on the website after entering their identifiers. He can add all the products indicated as available to his shopping cart using the relevant button which will be indicated on the Website.
3.2.2. The shopping cart remains free and can be modified until the Customer has finalised his/her purchase order.
4.2.3. Once the contents of his/her shopping basket have been confirmed, the Customer may confirm his/her Order by following these steps:
- Confirm products and selected quantities;
- Complete all the information requested by the Website;
- Accept the General Terms and Conditions of Sale without reservation by clicking on the button indicated;
- Confirm the payment by pressing the button indicated.
3.2.4. The Customer is solely responsible for the accuracy of the identification and delivery information it provides to the Seller when placing an Order on the Website.
4. Invoicing
After placing an order in the online shop http://colton.eu/, the Buyer will receive an automatic email with an invoice. Upon receipt of payment, the Seller will generate an invoice and send it to the Customer’s email address.
5. Order delivery
5.1. The Goods will be delivered to the Customer upon confirmation of payment of the Order, regardless of the method used. The Customer will be notified of the dispatch of the Goods by email.
5.2. In the event that an Order contains Products with delivery dates different from the time the Order is placed, it will be dispatched in one dispatch when all Products are available.
5.3. Orders are delivered within 1-5 working days (unless an exception is made). Delivery is available to all European Union countries.
5.4. The Customer accepts that the order may be delayed due to unforeseen circumstances (e.g. holidays, delays of the delivery company, etc.). If the Customer has not received his/her order, the Seller shall be informed of the delay at least 1 day after the estimated delivery date.
5.5. The Goods shall be delivered to the address specified by the Customer when placing an order on the Website. The Customer shall verify the completeness and conformity of the information provided to the Seller.
5.6 In the event of delay, damage, total or partial loss of the Goods and/or Order, the Customer must contact the Seller at info@colton.eu or call + 37068538751 no later than 1 working day after delivery. The Seller accepts full responsibility for correcting any error or malfunction caused by it.
6. Return and Refund Policy
6.1. The Seller shall inform the Customer of all technical characteristics of the Goods sold in accordance with the information provided by the Seller’s manufacturers.
6.2. If the Customer discovers any non-conformity or hidden defect in the Goods, the Customer must immediately inform the Seller of the defect within 7 working days after Delivery. In this case, the Goods shall be replaced with a quality product of the same model.
6.3. Returns shall be made only upon receipt of a request from the Customer explaining the reason for the return. In such cases, the Seller assumes full responsibility for refunding the order placed below or replacing the product with a quality product of the same model.
6.4. In the event of a price difference made by the Seller between the delivery of the order and the refund process, the Seller shall be fully liable to refund the same price as stated in the Customer’s receipt.
6.5. In all cases, the Goods must be sent in their original packaging, with labels and accessories, in perfect condition for resale. They must not be used or damaged.
7. Personal data
7.1. In order to process Orders, the Seller collects certain personal information and data about the Customer. The Seller has taken all necessary precautions to ensure the security of its files and the protection of its IT system and, in particular, to prevent the Personal Information of Customers from being distorted, corrupted or accessed by any unauthorised third party.
7.2. In order to fulfil Orders, the Customer undertakes to present proof of identity to the Seller and/or a third party at the time of delivery.
7.3. By selecting the “Newsletter” option on the Seller’s website, the Customer consents to the use of his/her personal information for commercial or statistical purposes and not to its disclosure to unauthorised third parties.
7.4. In order to process Orders, the Customer agrees that he/she is aware of his/her rights not to provide his/her personal data, but is also aware that these data are necessary to identify the Customer and to ensure the proper and legitimate conduct of the purchase and sale process.
7.5 In order for the Customer’s information to be deleted, the Customer must contact the Seller at info@colton.eu or +37068538751.
8. Delivery information
8.1. All information about the ordering and delivery process, including the purchase invoice, will be sent to the Customer’s email address provided at the time of placing the order;
8.2. Full details of the order, including the purchase invoice, can also be found on the Seller’s website if the order was placed by a registered Customer;
8.3. Any questions relating to the delivery order process can be addressed to the contact details provided in the “Contact” section of the Seller’s website http://www.colton.eu/.
9. Dispute
9.1. The Seller and the Customer agree that all information (including these Conditions, information about the Seller, a description of the Goods and their technical characteristics, the Customer’s payment and delivery options, and the warranty of the Goods (if applicable)) has been provided to the Customer in writing.
9.2. These Rules do not limit the rights of Clients under Lithuanian law.
9.3. All disagreements between the Seller and the Customer in relation to the Purchase and Sale Agreement shall be settled by negotiation. In the event of failure to reach an agreement, the dispute shall be settled in accordance with Lithuanian law.
9.4. The right to copy data from the Seller’s website shall be subject to the Seller’s written legal approval.
